Emergency Prescription Refill Coverage Mandate

Current understanding

Michigan’s Insurance Code (1956 PA 218) has included, at MCL 500.3406w, a requirement that health insurers cover emergency refills of prescription medication for up to a 30-day supply, with related provisions at sec. 3406o. SB0978 in the 103rd Michigan Legislature proposes to repeal sec. 3406w and amend sec. 3406o, which would eliminate this coverage mandate for insured patients needing emergency refills. The bill has passed one chamber.
