Protecting America’s Agricultural Land from Foreign Harm Act of 2025

Current understanding

Introduced legislation that would prohibit persons owned, controlled, or directed by the governments of China, Russia, Iran, or North Korea from purchasing or leasing U.S. public or private agricultural land and from participating in most USDA programs. The bill would also expand Agricultural Foreign Investment Disclosure Act (AFIDA) reporting to cover security interests and leases, tightening existing foreign agricultural land disclosure requirements. Status: introduced.

  • 2025-03-06 — PASS Act: cross-connection with pass-act: Both restrict foreign-adversary acquisition of U.S. agricultural land; the Protecting America’s Agricultural Land Act works through AFIDA disclosure and USDA program bars, while the PASS Act imposes outright prohibitions near military/national-security sites and adds CFIUS review. (novelty: 3)
  • 2025-02-18 — Protecting America’s Agricultural Land from Foreign Harm Act of 2025: cross-connection with foreign-agricultural-land-national-security: The bill directly amends AFIDA reporting scope (adding security interests and leases) and layers outright purchase/lease prohibitions on top of the existing foreign agricultural land national security regime. (novelty: 3)
