Wrongful Imprisonment Compensation Act
Current understanding
Michigan’s Wrongful Imprisonment Compensation Act (2016 PA 343, MCL 691.1752 et seq.) provides monetary compensation from the state to individuals who were wrongfully convicted and imprisoned, setting evidentiary standards for claimants to prove entitlement. SB 909 proposes to amend sections 2, 4, 5, and 7 to modify the evidence requirements a claimant must meet, potentially adjusting the burden of proof for wrongfully imprisoned individuals seeking state payouts.
