Foreclosure Deed Recording Requirements

Current understanding

Sections 3232 and 3240 of the Revised Judicature Act (1961 PA 236, MCL 600.3232 & 600.3240) govern the sheriff’s deed executed at a mortgage foreclosure sale, including how and when that deed must be recorded and the effect of recording on the redemption period and title. HB 5046 (103rd Legislature) would amend both sections to modify the procedural rules around recording the foreclosure deed.
