Physician Noncompete Agreement Prohibition

Current understanding

Michigan’s fair employment practices law (1984 PA 274, MCL 445.774a) governs the enforceability of noncompete agreements between employers and employees. HB 6119 (103rd Legislature) proposes amending sec. 4a to prohibit certain noncompete agreements for physicians, which would affect hospital systems, physician-employer contracts, and physician mobility across employers. The bill is at introduction stage.
