Freestanding Abortion Clinic Licensure

Current understanding

Michigan HB 6076 of the 103rd Legislature proposes to require freestanding abortion clinics to be licensed as a distinct category of health facility under the Public Health Code (1978 PA 368). The bill would add Part 207A and a new MCL 333.22224d, and amend the general health facility definitions and provisions at MCL 333.20104, 333.20106, and 333.20161 to incorporate freestanding abortion clinics into the state’s health facility licensing scheme. The bill has been introduced; if enacted, operators of freestanding abortion clinics would need to obtain the new license, while patients would receive services from a newly-regulated facility class.
