(Notice · Trade Representative, Office of United States) The United States Trade Representative (U.S. Trade Representative) has initiated an investigation pursuant to the Trade Act of 1974, as amended (Trade Act), with respect to Germany’s persistent underpayment for innovative pharmaceutical products. The inter-agency Section 301 Committee is holding a public hearing and seeking public comments in connection with this investigation.
Why this matters
This is the first Section 301 investigation in this vault to target a pharmaceutical pricing/reimbursement practice rather than a goods or IP practice, extending the trade instrument into drug pricing policy. For MPN-relevant therapies sold in Germany, an eventual adverse determination could translate into tariffs or other remedies that reshape transatlantic pricing dynamics, though the action is currently only at the initiation stage.
