Suitability Action Appeals
Key claim: OPM is issuing final regulations that replace the Merit Systems Protection Board with OPM as the adjudicative agency for suitability action appeals under 5 CFR part 731 in order to streamline procedures and improve efficiency, rigor, and timeliness.
Abstract
(Rule · Personnel Management Office) The Office of Personnel Management (OPM) is issuing final regulations to revise how an applicant, appointee, or employee may appeal a suitability action taken under 5 CFR part 731. OPM will replace the Merit Systems Protection Board (MSPB) as the adjudicative agency for such appeals. The change will streamline suitability action appeals procedures, thereby improving the efficiency, rigor, and timeliness by which OPM and agencies resolve challenges to suitability actions and ensure the integrity and efficiency of the service.
Why this matters
Moving suitability-action appeals out of the Merit Systems Protection Board and into OPM restructures a long-standing federal personnel appellate procedure, altering where and how applicants and employees can contest suitability determinations. For employers (federal agencies) it promises faster and more consistent adjudication, while for workers it changes the neutrality posture of the appeals forum since OPM is both the rulemaker and the adjudicator. This fits a wider pattern of OPM absorbing personnel-adjudication functions previously handled by independent boards.
