Improvements to Rules on Recoupment of Benefit Overpayments

Key claim: The PBGC proposes to simplify overpayment recoupment for single-employer terminated plans by adopting a flat 5% monthly benefit rate and eliminating recoupment from surviving beneficiaries.

Abstract

(Proposed Rule · Pension Benefit Guaranty Corporation) The Pension Benefit Guaranty Corporation (PBGC) is proposing to improve its rules on recoupment of benefit overpayments under PBGC’s insurance program for single-employer terminated plans trusteed by PBGC. These proposed improvements include changing the recoupment methodology to a flat rate of 5 percent of a participant’s monthly benefit and eliminating recoupment from a participant’s surviving beneficiary.

Why this matters

Benefit overpayment recoupment directly affects retirees relying on PBGC-guaranteed pensions when plans terminate underfunded, and the current methodology can produce uneven or burdensome repayment schedules. Adopting a flat 5% monthly rate and eliminating collection from surviving beneficiaries would provide more predictable outcomes for workers and simpler administration for employers and plan sponsors interacting with PBGC. The change is procedural but shifts financial exposure in the retiree’s favor at the margin.
