Endangered and Threatened Wildlife and Plants; Regulations Pertaining to Endangered and Threatened Wildlife and Plants

Key claim: The U.S. Fish and Wildlife Service is removing the blanket-rule option that automatically applied endangered-level protections to newly listed threatened species under ESA section 4(d).

Abstract

(Rule · Interior Department, Fish and Wildlife Service) We, the U.S. Fish and Wildlife Service (FWS or the Service), revise our regulations concerning protections of threatened species under the Endangered Species Act (Act). We are removing the “blanket rule” option for protecting newly listed threatened species pursuant to section 4(d) of the Act.

Why this matters

Eliminating the 4(d) blanket rule shifts the ESA default for newly listed threatened species from automatic endangered-level take prohibitions to case-by-case, species-specific protections crafted at listing. In practice this reduces baseline regulatory burden on landowners, developers, and permitting agencies while increasing FWS workload and creating potential gaps in protection during rulemaking delays. Conservation groups and industry are likely to contest individual 4(d) rules more intensely now that they carry the full weight of threatened-species protection.
