First Responder Fair RETIRE Act
Key claim: OPM proposes regulations so covered Federal first responders with a qualifying duty-related illness or injury keep CSRS/FERS retirement benefits as if they had not become disabled.
Abstract
(Proposed Rule · Personnel Management Office) The Office of Personnel Management proposes regulations to carry out provisions of the First Responder Fair Return for Employees on Their Initial Retirement Earned Act. The Act allows covered Federal first responders who experience a qualifying duty-related illness or injury to continue receiving Federal retirement benefits in the same manner as though they had not experienced the disability. The proposed regulations would carry out the amendments the Act made to statutory provisions relating to the Civil Service Retirement System and the Federal Employees’ Retirement System.
Why this matters
For federal first responders, the special CSRS/FERS retirement formulas (earlier eligibility, higher accrual) are typically forfeited if a duty-related injury forces reassignment to a non-covered position. This proposed rule operationalizes the Fair RETIRE Act so affected workers can keep accruing benefits as if still in their covered role, changing how agencies must handle post-injury placements and retirement bookkeeping.
