Extension of Compliance Dates for Nondiscrimination on the Basis of Disability; Accessibility of Web Content and Mobile Applications of Recipients of Departmental Financial Assistance

Key claim: HHS is extending by one year the compliance deadlines for web content and mobile application accessibility requirements under Section 504 of the Rehabilitation Act, giving larger recipients until May 2027 and smaller recipients until May 2028.

Abstract

(Rule · Health and Human Services Department) By this interim final rule (“IFR”), the Department of Health and Human Services (“Department”) is revising the Department’s regulations implementing section 504 of the Rehabilitation Act (“section 504”) to extend the compliance dates for the requirements for web content and mobile application (“app”) accessibility that were adopted on May 9, 2024. The compliance date for recipients with fifteen (15) or more employees is extended from May 11, 2026, to May 11, 2027. The compliance date for recipients with fewer than fifteen (15) employees is extended from May 10, 2027, to May 10, 2028.

Why this matters

For people with disabilities who rely on federally funded health and human services programs, the one-year extension delays enforceable access to web portals and mobile applications used for enrollment, appointments, benefits, and clinical information. The substantive WCAG-aligned obligations are unchanged, but recipients gain additional time to remediate, and affected users must continue relying on alternative-format accommodations in the interim. The extension illustrates the practical tension between implementation burden on covered entities and timely realization of disability civil rights.
