Native American Entrepreneurial Opportunity Act

Key claim: HR7396 would give statutory authority to the SBA’s Office of Native American Affairs, directing it to target entrepreneurial development, contracting, and capital access programs toward members of Indian tribes and Native Hawaiian organizations.

Abstract

(HR7396 · 119th Congress) Native American Entrepreneurial Opportunity Act This bill provides statutory authority for the establishment of the Office of Native American Affairs within the Small Business Administration (SBA). The office must establish a working relationship with Indian tribes and Native Hawaiian organizations by targeting SBA programs relating to entrepreneurial development, contracting, and capital access to (1) establish or expand small businesses owned and controlled by individuals who are members of Indian tribes or Native Hawaiian organizations, and (2) promote economic development in Indian country. Latest action (2026-06-24): Received in the Senate and Read twice and referred to the Committee on Small Business and Entrepreneurship.

Why this matters

Codifying the SBA’s Office of Native American Affairs matters less for immediate program mechanics than for the durability and legal framing of Native-targeted federal economic programs. Statutory grounding insulates the office from administrative rollback and anchors its tribal-membership targeting in a political (government-to-government) rather than racial classification, which is increasingly relevant as courts scrutinize race-conscious federal contracting and capital-access programs.
