PASS Act — Foreign Adversary Restrictions on U.S. Agricultural Land & Companies
Current understanding
The PASS Act would prohibit persons linked to China, Russia, Iran, or North Korea from purchasing or leasing U.S. agricultural land located near sensitive military or national-security sites, and from acquiring control of U.S. agricultural companies. It would also add the Secretary of Agriculture to CFIUS for agriculture-related transactions, layering adversary-specific bans on top of existing CFIUS and AFIDA disclosure frameworks.
