FARMLAND Act of 2025
Current understanding
The FARMLAND Act of 2025 would expand CFIUS jurisdiction to cover foreign transactions in U.S. land exceeding $5 million or 320 acres when used for agricultural production or critical materials, and would add the Secretary of Agriculture and the FDA Commissioner as CFIUS members. It would also strengthen Agricultural Foreign Investment Disclosure Act (AFIDA) enforcement, bar foreign landowners from Farm Service Agency programs, and require a joint USDA–DHS database of foreign-owned agricultural land. Effect: raises compliance and review burden on foreign investors in U.S. farmland and critical-materials land; limited direct effect on consumer prices.
