DMCA Section 1201 triennial exemption rulemaking
Current understanding
Every three years, the U.S. Copyright Office and Librarian of Congress conduct a rulemaking under 17 U.S.C. § 1201 to consider temporary exemptions to the prohibition on circumventing technological protection measures (TPMs) that control access to copyrighted works. Petitioners may seek renewal of existing exemptions or propose new ones (e.g., for security research, repair, accessibility, preservation, or text and data mining), with the Office evaluating whether users of a class of works are, or are likely to be, adversely affected in their ability to make noninfringing uses. The tenth triennial cycle has been initiated to accept petitions.
