Tribal Police Department Parity Act – NFA/GCA Law Enforcement Parity
Current understanding
The Tribal Police Department Parity Act would extend to Indian tribes and tribal law enforcement agencies the same National Firearms Act (NFA) transfer tax exemptions and Gun Control Act (GCA) firearms access provisions currently available to federal, state, and local law enforcement. Under current law, tribal agencies are not consistently included in the governmental class exempted from NFA §5852/§5853 transfer taxes or granted equivalent GCA acquisition parity, creating disparate treatment relative to other sovereign law enforcement bodies.
