VA-to-NICS Reporting Based on Fiduciary Status
Current understanding
The Department of Veterans Affairs currently reports veterans and beneficiaries who have been assigned a fiduciary to manage their benefits to the FBI’s National Instant Criminal Background Check System (NICS), which disqualifies them from firearm purchases. The Veterans 2nd Amendment Protection Act of 2025 (introduced) would restrict such reporting to cases involving a judicial finding of dangerousness, narrowing the administrative data flow from VA to NICS and raising the threshold for adverse consequences tied to fiduciary appointment.
