FLSA White-Collar Exemptions Rule (2024 Vacatur & Restoration)

Current understanding

The Department of Labor is amending 29 CFR Part 541 to remove the vacated 2024 rule that had raised salary thresholds for the executive, administrative, professional, outside sales, and computer employee (EAP) overtime exemptions under the Fair Labor Standards Act. Federal courts vacated the 2024 rule, and this technical final rule restores the pre-2024 regulatory text (including the salary thresholds set by the 2019 rule). For workers, this means the higher salary cutoffs for overtime eligibility do not take effect; for employers, the pre-2024 exemption criteria remain the operative test.
