Legislative proposal introduced in the 119th Congress that would prohibit CMS from administering or enforcing its May 2024 final rule setting minimum nurse staffing standards for Medicare- and Medicaid-participating long-term care facilities and requiring state Medicaid reporting on payments to direct care workers. Status: introduced. If enacted, LTC facilities would not face the federal minimum staffing floor (including the 24/7 RN requirement and hours-per-resident-day standards) and states would not have to report Medicaid direct care worker compensation data.
