The RED Tape Act (HR6398, introduced) would amend the Clean Air Act to eliminate Section 309, which currently requires EPA to review and publicly comment on the environmental impact of federal construction projects, other major federal actions subject to NEPA, and proposed federal regulations. Proponents frame it as removing duplicative review for actions already covered by NEPA; the practical effect would end EPA’s independent CAA §309 comment role and the referral pathway to the Council on Environmental Quality for unsatisfactory actions.
