FIFRA Preemption of State Pesticide Labeling Claims

Current understanding

The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) governs pesticide registration and labeling through EPA, and Section 136v(b) bars states from imposing labeling or packaging requirements that differ from or add to federal requirements. Courts have divided over whether state-law failure-to-warn tort claims — particularly claims that a glyphosate (Roundup) label should have carried a cancer warning — are ‘requirements’ preempted by FIFRA when EPA has declined to require such a warning. In Monsanto v. Durnell, the U.S. Supreme Court held such failure-to-warn claims are expressly preempted, resolving a split among circuits and state high courts and materially reshaping tort exposure for pesticide manufacturers.

Evidence log

  • 2026-06-30 — Paraquat Prevention Act: cross-connection with paraquat-prevention-act: Federal restriction on paraquat sits alongside ongoing debates over FIFRA preemption of state pesticide labeling and use claims. (novelty: 2)
  • 2026-02-20 — No Immunity for Glyphosate Act: cross-connection with no-immunity-for-glyphosate-act: HR7601 targets the same FIFRA-preemption/product-liability pathway that shields pesticide manufacturers from state failure-to-warn claims; removing immunity would functionally reopen state tort exposure that FIFRA preemption doctrine currently limits. (novelty: 3)
  • 2026-06-25 — Monsanto v. Durnell: cross-connection with pesticide-tolerances: EPA’s pesticide regulatory scheme operates on parallel tracks — FFDCA tolerances for food residues and FIFRA registration/labeling for use — both of which now serve as bases for federal preemption of divergent state requirements after Monsanto v. Durnell. (novelty: 4)
