DOE Regulatory Sunset Review (EO 14270)

Current understanding

The Department of Energy is proposing to insert conditional sunset provisions into certain of its regulations pursuant to the Zero-Based Regulatory Budgeting Executive Order (EO 14270, April 9, 2025). Under this approach, covered DOE rules would expire on a date certain unless affirmatively re-justified and readopted, shifting the default from continuation to expiration. Practical effects on energy sector compliance, appliance and efficiency standards, nuclear/atomic energy assistance rules, and grants administration will depend on which regulations DOE places under sunset and how re-justification is conducted.
