FARMLAND Act of 2025
Current understanding
The FARMLAND Act of 2025 would expand CFIUS jurisdiction to cover foreign transactions involving U.S. agricultural land or land tied to critical materials when the deal exceeds $5 million or 320 acres, and would add the Secretary of Agriculture and the FDA Commissioner as CFIUS members. It would also strengthen Agricultural Foreign Investment Disclosure Act (AFIDA) enforcement, bar foreign landowners from Farm Service Agency programs, and require USDA and DHS to jointly maintain a database of foreign-owned agricultural land.
