DFARS Foreign Ownership, Control, or Influence Mitigation (DFARS Case 2021-D011)
Current understanding
DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement NDAA FY2020 and FY2021 provisions requiring mitigation of risks arising from foreign ownership, control, or influence (FOCI) over defense contractors. The proposed rule would add contract clauses, disclosure requirements, and mitigation frameworks applicable to covered DoD acquisitions. Status: proposed rule; comment period and final rule scope not yet established.
