DETERRENCE Act (Foreign-Government-Directed Sentencing Enhancements)
Current understanding
The DETERRENCE Act (S1136) would create sentencing enhancements applicable to federal criminal offenses that are directed by, or coordinated with, a foreign government. It introduces a cross-cutting counter-foreign-interference tool at the sentencing stage rather than defining new substantive offenses, and would affect DOJ charging and sentencing practice across national security, cyber, economic espionage, and transnational repression cases.
