ATF is issuing a final rule to conform its Contraband Cigarette Trafficking Act (CCTA) regulations to the 2005 USA PATRIOT Improvement and Reauthorization Act, which lowered the definitional threshold for contraband cigarettes from 60,000 to 10,000 units, extended CCTA coverage to smokeless tobacco, and expanded record-keeping and reporting obligations for distributors and common carriers. The rule is implementing housekeeping for a two-decade-old statute rather than a new policy direction, but it does formally bring smokeless tobacco within ATF’s trafficking enforcement scope and tightens the transaction volume that triggers federal reporting. Fiscal implications are limited to modest compliance costs for tobacco distributors and incremental ATF enforcement activity; status: final rule.
