FARMLAND Act of 2025
Current understanding
The FARMLAND Act of 2025 is introduced legislation that would broaden CFIUS jurisdiction to cover foreign acquisitions of U.S. agricultural or critical-materials land exceeding $5 million or 320 acres, add the USDA Secretary and FDA Commissioner as CFIUS members, and strengthen enforcement of AFIDA disclosure requirements. It would also bar foreign landowners from participating in Farm Service Agency programs and direct USDA and DHS to build a joint database of foreign-owned agricultural land. Status: introduced; effects on farmers, consumers, and food prices depend on how broadly ‘critical materials’ land and FSA program bars are interpreted.
